What is involved in mandatory electronic invoicing

On September 15, 2022, the Congress of Deputies definitively approved the new Law for the Creation and Growth of Companies (Crea y Crece Law). This law obliges companies and freelancers to implement electronic invoicing in their entities.

Time

The standard establishes a period of 6 months from the publication of the law for the administrations involved to determine the technical and information requirements to be included in the electronic invoice.

Depending on the size of the company, different implementation deadlines have been foreseen:

  • Para las empresas que facturen más de 8M€ al año, sobre la primavera del 2024.
  • For all other companies, by spring 2025.

 

With this change, Spain joins other European countries such as Italy or France in the generalization of the use of electronic invoicing in the field B2B and B2G.

Obligations of companies and the self-employed

  • Issue and send electronic invoices with other companies and freelancers.
  • Facilitate access, viewing, downloading and printing of the electronic invoice for recipients.
  • Maintain access to electronic invoices for 4 years, even when the recipients of the invoices are no longer customers of the issuing companies.

 

The aim is to promote business digitalization within the framework of the Recovery and Resilience Plan for European aid.
